On the issue of government recalled cribs etc, why can't people just be more responsible?

In the news recently it was said that certain drop down cribs are to be banned from all sales. Including the used cribs at flea markets, garage sales etc. Why should the government have to make people stop selling those recalled faulty cribs or else face a fine or jail time? Why can't people be responsible?
